These Terms of Service (“Terms”) form a binding agreement between you and [INSERT LEGAL ENTITY NAME], doing business as Happy Homeschoolers™ (“Happy Homeschoolers,” “we,” “us,” or “our”). These Terms govern access to and use of our website, mobile or web application, directories, community areas, resource library, marketplace features, newsletters, events, payment pages, and related services (collectively, the “Platform”).
BY CREATING AN ACCOUNT, PURCHASING A MEMBERSHIP, CLICKING “SUBSCRIBE,” CHECKING AN ACCEPTANCE BOX, OR USING THE PLATFORM, YOU ACKNOWLEDGE THAT YOU HAVE READ AND AGREE TO THESE TERMS AND THE OTHER POLICIES IN THIS LEGAL CENTER.
1.1 Eligibility and Adult Accounts
You must be at least 18 years old and legally able to enter into a contract to create an account, purchase a membership, list products or services, or communicate with providers through the Platform. Accounts are intended for parents, legal guardians, educators, service providers, vendors, and authorized representatives of organizations—not for children.
You may not allow a minor to create or independently control an account. Parents and legal guardians remain responsible for supervising a child’s use of any resources, classes, communications, or activities accessed through the Platform.
1.2 Account Information and Security
· Provide accurate, current, and complete information.
· Keep login credentials confidential and do not share accounts.
· Promptly update payment, contact, professional, and business information.
· Notify us promptly of suspected unauthorized access, impersonation, or security concerns.
· Do not create duplicate accounts to evade restrictions, suspensions, fees, or moderation decisions.
1.3 Membership Categories
Happy Homeschoolers™ may offer free and paid memberships for parents, Parent Vendors, Vendors, Educators, Featured Educators, Community Partners, Featured Community Partners, and other categories. Each membership includes only the benefits displayed at the time of enrollment, subject to these Terms and reasonable future changes.
Paid placement, badges, newsletter spotlights, “featured” status, referrals, rotations, or promotional opportunities do not represent certification, endorsement, safety approval, or a guarantee of traffic, customers, enrollment, income, or results.
1.4 Independent Providers and No Agency Relationship
Vendors, educators, tutors, specialists, community organizations, event hosts, advertisers, and other listed providers are independent third parties. They are not employees, agents, partners, franchisees, or representatives of Happy Homeschoolers™. Membership does not create an employment, partnership, fiduciary, joint-venture, agency, or franchise relationship.
Unless expressly stated in writing, Happy Homeschoolers™ does not supervise providers, control their work, set their prices, process their customer transactions, guarantee their credentials, or assume responsibility for their products, services, statements, conduct, cancellations, refunds, taxes, or legal compliance.
1.5 Directory and Referral Disclaimer
Directory listings and referrals are provided for convenience and connection only. Families and organizations must independently evaluate providers, verify licenses and credentials, check references, review insurance, confirm safety practices, and determine suitability before purchasing, meeting, hiring, or allowing contact with children.
A listing, badge, newsletter mention, referral, featured placement, or event posting is not a background check, certification, endorsement, guarantee, or representation that a provider is safe, qualified, licensed, insured, or appropriate for a particular child or family.
1.6 Permitted Use
You may use the Platform only for lawful personal, family, educational, community, or authorized business purposes consistent with your membership. You may not scrape data, harvest contact information, reverse engineer the Platform, circumvent access controls, interfere with service operation, or use the Platform to build a competing directory, membership community, database, or marketplace.
1.7 User Content
“User Content” includes profiles, listings, logos, photographs, videos, reviews, posts, event information, product descriptions, course descriptions, downloadable materials, comments, testimonials, and other content submitted to the Platform.
You retain ownership of your User Content. By submitting it, you grant Happy Homeschoolers™ a nonexclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, resize, format, display, distribute, and use that content solely to operate, secure, improve, and promote the Platform and the member’s listing or participation. This license ends when the content is deleted, except for reasonable backup retention, legal records, and promotional materials already created or distributed with permission.
You represent that you own or have all necessary rights and permissions for your User Content and that it does not violate privacy, publicity, copyright, trademark, contractual, or other rights.
1.8 Monitoring and Enforcement
We may, but are not required to, review content or investigate conduct. We may edit formatting, reject, remove, restrict, preserve, or disclose content; suspend features; cancel listings; or terminate accounts when we reasonably believe content or conduct violates these policies, creates risk, is unlawful, is misleading, harms the community, or exposes Happy Homeschoolers™ or others to liability.
1.9 Platform Changes and Availability
We may add, remove, suspend, replace, or modify features, benefit limits, directories, technology providers, and membership structures. We do not guarantee uninterrupted operation, permanent storage, specific availability, compatibility, search placement, referral volume, or continued availability of any third-party integration.
1.10 Third-Party Services and Links
The Platform may use or link to third-party services, including Stripe, Google, email providers, forms, analytics, video-conferencing services, and independent provider websites. Third parties have their own terms, privacy practices, security controls, and availability. Happy Homeschoolers™ is not responsible for third-party content, transactions, policies, outages, or conduct.
1.11 Suspension and Termination
You may stop using the Platform or cancel a paid membership according to the Billing Policy. We may suspend or terminate access for nonpayment, fraud, safety concerns, unlawful activity, harassment, spam, misrepresentation, intellectual-property infringement, policy violations, repeated complaints, or conduct that threatens the Platform or community.
Termination does not erase amounts already owed. Provisions concerning ownership, payment obligations, disclaimers, indemnification, limitations of liability, dispute resolution, and lawful record retention survive termination.
1.12 Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, SECURITY, AVAILABILITY, AND RESULTS. WE DO NOT WARRANT THAT CONTENT, PROVIDERS, LISTINGS, RESOURCES, EVENTS, OR SERVICES WILL MEET YOUR NEEDS OR BE ERROR-FREE, SAFE, CURRENT, OR SUITABLE.
1.13 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAPPY HOMESCHOOLERS™ AND ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS; LOST DATA; BUSINESS INTERRUPTION; PERSONAL DISPUTES; PROVIDER CONDUCT; OR THIRD-PARTY PRODUCTS, SERVICES, EVENTS, OR TRANSACTIONS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING FROM THE PLATFORM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY TO HAPPY HOMESCHOOLERS™ DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain exclusions, so these limits apply only to the extent legally permitted.
1.14 Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Happy Homeschoolers™ and its representatives from claims, losses, liabilities, damages, judgments, costs, and reasonable attorneys’ fees arising from your User Content, products, services, events, conduct, legal violations, tax obligations, infringement, misrepresentations, or breach of these policies.
1.15 Governing Law and Venue
These Terms are governed by Tennessee law, without regard to conflict-of-law principles. Before filing a lawsuit, the parties agree to provide written notice of the dispute and make a good-faith effort to resolve it informally for at least 30 days. Unless applicable law requires otherwise, court proceedings must be brought in the state or federal courts serving [INSERT COUNTY], Tennessee. This draft does not require mandatory arbitration or waive class-action rights; obtain legal advice before adding those provisions.
1.16 Changes to These Terms
We may revise these Terms. We will post the updated version and change the “Last Updated” date. For material changes affecting recurring billing, privacy, or legal rights, we will provide additional notice and obtain consent when required by law. Continued use after the effective date of a non-material update constitutes acceptance.
2. Membership Billing, Automatic Renewal, Cancellation & Refund Policy
2.1 Prices and Billing Intervals
Membership prices, billing intervals, trial terms, and included benefits are displayed at checkout or on the applicable offer page. Prices are stated in U.S. dollars unless otherwise indicated. Taxes may be added when legally required and properly configured.
2.2 Automatic Renewal
Paid monthly and annual memberships automatically renew at the end of each billing period until canceled. By subscribing, you authorize Happy Homeschoolers™ and its payment processor to charge the payment method on file for each renewal, plus applicable taxes, after any disclosed trial or promotional period.
The automatic-renewal terms, price, billing frequency, and cancellation method should be displayed clearly before purchase. A confirmation or receipt will be sent to the email address provided at checkout.
2.3 Cancellation
You may cancel through the Stripe Customer Portal or another online cancellation method identified on the website or in your purchase confirmation. Cancellation stops future renewals and normally takes effect at the end of the current paid billing period. You will retain access through that date unless access is terminated earlier for policy violations, fraud, chargeback abuse, or safety reasons.
Cancellation does not automatically delete your Platform account or public content. Submit a separate deletion request if you want eligible account information removed.
2.4 Proposed Refund Policy — Confirm Before Publication
PROPOSED POLICY: Membership fees are nonrefundable once charged, including partial-month or partial-year periods, unused benefits, changes of mind, failure to use the Platform, or removal resulting from a policy violation, except where required by law or where Happy Homeschoolers™ expressly approves a refund in writing. Duplicate charges and verified billing errors will be corrected.
2.5 Failed Payments and Account Status
If a payment fails, Stripe may retry the charge and send notices. We may suspend paid benefits until the balance is paid. If a subscription ends because of failed payment or cancellation, promotional or legacy pricing may be lost upon re-enrollment.
2.6 Price and Benefit Changes
We may change future prices or membership benefits. Material price changes will apply no earlier than the next renewal after legally required notice. Annual members ordinarily retain paid access through the end of their current term, subject to safety, fraud, legal compliance, or Platform discontinuation.
2.7 Founding or Charter Educator Rate
Any Founding Teacher, Founding Educator, or Charter Educator rate is governed by the written offer presented at enrollment. Unless that offer states otherwise: the rate is personal and nontransferable; continued eligibility requires uninterrupted paid membership; cancellation, failed payment, chargeback, or termination may permanently end eligibility; benefits may evolve as the Platform changes; and the rate does not guarantee lifetime operation of the Platform. 2.8 Chargebacks
Contact customer service before initiating a chargeback so we can investigate. Fraudulent or abusive chargebacks may result in suspension, termination, collection activity, or loss of promotional pricing. This does not limit lawful billing-dispute rights.
5. Community Standards
5.1 Expected Conduct
· Be respectful, truthful, and constructive.
· Protect children’s privacy and personal safety.
· Use appropriate language and age-appropriate content.
· Respect differences in lawful educational approaches and family choices.
· Post in the correct areas and follow membership-specific posting limits.
· Disclose relevant business, affiliate, sponsorship, or promotional relationships.
5.2 Prohibited Conduct
· Harassment, threats, stalking, bullying, hate speech, discriminatory abuse, or sexual content.
· Spam, repetitive solicitation, unauthorized direct marketing, contact harvesting, or selling inside parent-only community spaces.
· Fraud, impersonation, deceptive claims, manipulated reviews, pyramid schemes, or misleading income promises.
· Sharing private or confidential information without permission.
· Dangerous challenges, instructions facilitating wrongdoing, or content that creates a credible safety risk.
· Malware, scraping, bots, interference, unauthorized access, or evasion of moderation.
· Posting illegal, infringing, counterfeit, stolen, recalled, or prohibited products or services.
5.3 Parent Community Protections
Vendor and Educator memberships do not automatically include a right to promote inside parent community discussions. Sellers may participate only in areas expressly authorized for their membership and must not use community access to pressure, repeatedly message, or solicit parents.
5.4 Moderation
We may remove content, limit visibility, issue warnings, restrict features, require corrections, suspend accounts, or terminate participation. Moderation decisions are discretionary and may consider context, severity, history, safety, legal risk, and community impact. We do not guarantee review of every post or resolution of every dispute.
5.5 Appeals
A member may request review of a moderation decision by contacting customer service with relevant facts. Appeals do not pause safety restrictions or payment obligations and do not guarantee reinstatement.

14.2 How the Policies Work Together
The Terms of Service and all policies in this Legal Center are incorporated into one agreement. If a more specific policy conflicts with a general provision, the more specific policy controls for that subject. Checkout disclosures and written offer terms control pricing and billing details for a particular purchase.
14.3 Electronic Acceptance
Electronic acceptance, including clicking a button, checking a box, creating an account, or completing a purchase, has the same effect as a written signature to the extent permitted by law. Users should save or print a copy of the policies and purchase confirmation for their records.
14.4 Severability and No Waiver
If a provision is held unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue. Failure to enforce a provision is not a waiver of the right to enforce it later.
14.5 Entire Agreement
These policies, applicable checkout disclosures, posted membership terms, and any written supplemental agreement constitute the entire agreement concerning the Platform and replace prior discussions or representations on the same subject.
